Terms & Conditions
Silver Shop (“Silver Shop”, “we” or “our”) is owned by, and refers to, Pivotal Ltd. Sale of any products or services is expressly
conditioned on Buyer’s assent to these Terms and Conditions. Any sales is expressly limited to the acceptance of these Terms
and Conditions. Any order to purchase products or receive services shall constitute Buyer’s assent to these Terms and
Conditions. No purchaser shall modify these Terms and Conditions, nor shall any course of performance, course of dealing, or
usage of trade operate as a modification or waiver of these Terms and Conditions.
All sales are considered final and claims for refunds are not accepted.
Warranty
This Limited Warranty applies to physical goods, and only physical goods, purchased from Silver Shop, identified by serial
number and purchase receipt.
Silver Shop warrants the original purchaser that the products shall be free from defects in materials and workmanship under
normal use for a minimum period of one (1) year from the date of purchase and six (6) months for spare parts. If a longer
warranty period is provided for the products, it will be stated on the purchase receipt.
Silver Shop does not warrant the operation of the product will be uninterrupted or error-free.
Silver Shop is not responsible for damage arising from the failure to follow instructions relating to the product’s usage.
The customer is required to present proof of purchase details with IMEI of the Product. It is the customer’s responsibility to
backup any data, software, or other materials that may have been stored or preserved on the product. It is likely that such data,
software, or other materials will be lost or reformatted during service, and Silver Shop will not be responsible for any such
damage or loss.
Coverage
If a hardware defect is found and a valid claim is received by Silver Shop within the Warranty Period, Silver Shop will, at its option
and to the extent permitted by law, either (1) repair the product at no charge, use new or refurbished replacement parts or, (2)
replace the product with a new or refurbished product. In the event of a defect, to the extent permitted by law, these are the sole
and exclusive remedies. Shipping and handling charges may apply. Any replacement hardware product will be warranted for the
remainder of the original warranty period or thirty (30) days, whichever is longer. The purchaser will have to bear any delays that
may be caused by diagnostics, importation of parts and repair work. The product must be in its original packaging, with all
documents and accessories with the product included. Accessories included with the product (chargers, cables, cases etc.) and
battery degradation are not covered under this warranty.
Out-of-warranty repairs
Out-of-warranty repairs are warrantied for six (6) months, as from the date that the device has been returned to the customer.
Silver Shop engages itself to perform repairs commissioned to the best of its ability.
Any previous repairs that have been done by the user or a third-party will have to be disclosed before the start of any work Silver
Shop reserves the right to refuse any repairs or warranty claims on spare parts if not disclosed immediately. Silver Shop is not
responsible for any damage that may occur during repairs.
Exclusions and Limitations
The Limited Warranty does not apply to any (a) Damage due to acts of nature or God, for example, lightning strikes, tornadoes
and the like; (b) Negligence; (c) Commercial use; (d) Modifications to any part of the Product; (e) Damage caused by use with
unauthorised products described by the device manufacturer; (f) Damage caused by accident, abuse, misuse, flood, fire,
earthquake or other external causes; (g) Damage caused by operating the Product outside the permitted or intended uses or with
improper voltage or power supply, as described by the device manufacturer; (h) Damage caused by service (including upgrades
and expansions) performed by anyone who is not a representative of Silver Shop; (i) Wear and Tear, scratches, dents or other
cosmetic damages; (j) Any Solid or Liquid ingress in the device. Recovery and reinstallation of software programs and user data
are not covered under this Limited Warranty. No Silver Shop reseller, agent, or employee is authorised to make any modification,
extension, or addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of
the remaining terms shall not be affected or impaired.
Silver Shop shall not be liable for any incidental, indirect, special, or consequential damages, including but not limited to loss of
profits, revenue or data, resulting from any breach of express or implied warranty or condition, or under any other legal theory,
even when Silver Shop has been advised of the possibility of such damages.
